1. OVERVIEW AND ACCEPTANCE

This website is operated by Lucid and Wild Collective (also referred to as “Lucid and Wild,” “we,” “us,” or “our”). Throughout these Terms and Conditions (“Terms”), “you” and “your” refer to every visitor, customer, purchaser, or user of LucidAndWildCollective.com and its related services.

By accessing our website, placing an order, purchasing or using a product or service, downloading digital content, participating in a ritual, or otherwise using our website and services (collectively, the “Service”), you agree to these Terms and all policies, product descriptions, instructions, warnings, and disclaimers incorporated into them. If you do not agree, do not use the Service or complete a purchase.

Our store is hosted by Shopify Inc., which provides the ecommerce platform through which we offer our products and services.

2. INCORPORATED POLICIES AND LISTING-SPECIFIC TERMS

These Terms incorporate our current:

Every product listing may contain directions, limitations, safety warnings, disclaimers, processing information, or eligibility requirements specific to that offering. By purchasing an item, you acknowledge that you have reviewed and accepted the information presented in its listing.

If a product listing contains a specific instruction or safety warning, that product-specific term controls for that product. A signed or expressly accepted wholesale agreement controls if it conflicts with these general Terms. All policies remain subject to rights that cannot lawfully be waived.

3. ELIGIBILITY AND ADULT SUPERVISION

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to make a purchase. Products used by a minor must be purchased and appropriately supervised by a parent or legal guardian. Candles, incense, oils, herbs, crystals, curios, and small ritual components must be stored securely away from children and pets.

You may not use our Service or products for an unlawful, unsafe, or unauthorized purpose or in violation of any applicable law.

4. PRODUCT AVAILABILITY, DESCRIPTIONS, AND HANDCRAFTED VARIATIONS

Products and services may be offered exclusively online, in limited quantities, seasonally, or for a limited time. We may revise, limit, suspend, or discontinue products, services, promotions, or quantities at any time, subject to applicable law.

We make reasonable efforts to present accurate descriptions, photographs, colors, measurements, ingredients, and availability. Screens and devices may display colors differently. Because many items are handcrafted or contain natural materials, their color, scent, texture, botanical appearance, stone pattern, or other characteristics may vary between batches. Reasonable natural or handmade variations are not defects.

We may correct typographical errors, pricing errors, inaccuracies, or omissions and may update information or cancel an affected order. If we cancel an order after payment because of our error or inability to fulfill it, we will refund the affected purchase amount to the original payment method.

5. ORDERS, BILLING, AND ORDER ACCEPTANCE

An order confirmation acknowledges that we received your order; it does not require us to accept or fulfill an order that is fraudulent, unlawful, unsafe, affected by an error, outside our shipping limitations, or otherwise cannot reasonably be fulfilled.

You agree to provide complete and accurate billing, shipping, contact, and payment information. You are responsible for reviewing your items, quantities, selections, shipping address, and email address before completing checkout.

We may refuse, limit, or cancel orders that reasonably appear to involve fraud, unauthorized payment, abusive conduct, unauthorized resale, circumvention of quantity limits, or a violation of these Terms. If we cancel an order, any refund legally due will be returned to the original payment method.

Prices and promotions may change without notice. Unless expressly stated otherwise, discounts cannot be combined, applied retroactively, exchanged for cash, or added after checkout.

6. FINAL SALES, CANCELLATIONS, AND SUBSTITUTIONS

All sales are final. Due to the personal, hygienic, handcrafted, limited-batch, customized, digital, and spiritual nature of many offerings, we do not accept returns, exchanges, or customer-requested cancellations except where required by applicable law.

Please review your order carefully before submitting payment. Once an order is placed, work may begin immediately through inventory reservation, customization, spiritual preparation, production, downloading, scheduling, or fulfillment.

If you contact us before processing or fulfillment begins, we may, at our discretion, approve a substitution for another available item of equal or lesser value. Substitutions are a courtesy and are not guaranteed. No substitution is approved unless confirmed by us in writing.

Substitutions cannot be made after an item has been made, customized, spiritually prepared, packaged, fulfilled, shipped, downloaded, delivered, scheduled, or included in a ritual already in preparation. Digital products, readings, community rituals, custom items, personalized products, and completed or commenced services cannot be changed once preparation or delivery begins.

If we approve an item of lesser value, the difference will not be refunded or issued as store credit. An item of greater value requires a separate purchase unless we expressly authorize another arrangement.

7. SHIPPING, DELIVERY, AND ADDRESS RESPONSIBILITY

Processing time is separate from carrier transit time. Any delivery date or transit estimate is an estimate rather than a guarantee unless expressly stated otherwise. Delays caused by carriers, severe weather, emergencies, peak seasons, customs, incorrect addresses, or circumstances outside our reasonable control may occur.

You are responsible for providing a complete and accurate deliverable address. Address-change requests are not guaranteed and are effective only when confirmed by us in writing. We cannot redirect or retrieve an order after it has shipped.

Once a package is transferred to the carrier, transit and delivery are handled by that carrier. A carrier delivery scan is evidence of delivery. If tracking shows delivery but you cannot locate the package, promptly check with household members and neighbors and contact your local carrier or post office. We will provide available shipment information to assist with an appropriate carrier inquiry, but we do not guarantee replacement or reimbursement for theft, loss after confirmed delivery, an incorrect customer-provided address, or events outside our control, except where required by law.

Claims involving an item that arrived damaged, defective, or incorrect must be sent to support@lucidandwildcollective.com within seven calendar days after tracked delivery. Include the order number, a description of the issue, photographs of the item, all packaging, and the shipping label. Keep the item and packaging until we finish reviewing the claim. Reporting an issue does not automatically guarantee a refund or replacement; available remedies will be determined under the applicable policy and law.

8. DIGITAL PRODUCTS, READINGS, RITUALS, AND SERVICES

Digital downloads, guides, courses, ritual materials, readings, community rituals, and similar services are final sale once purchased, accessed, downloaded, scheduled, prepared, or commenced, except where applicable law requires otherwise.

Delivery timing, participation requirements, and the scope of each reading, ritual, or service are described in the applicable listing. Failure to submit requested information or participate does not necessarily create a right to cancellation, rescheduling, credit, or refund.

Readings, rituals, and spiritual services are offered for spiritual reflection, inspiration, education, or entertainment. They are not guaranteed predictions and must not serve as the sole basis for medical, mental-health, legal, financial, employment, relationship, or other significant decisions.

9. SPIRITUAL AND METAPHYSICAL DISCLAIMER

References to attraction, protection, cleansing, abundance, confidence, love, luck, manifestation, energetic shifts, spiritual connection, or similar intentions describe the traditional, spiritual, symbolic, or metaphysical purpose of an offering.

We do not promise or guarantee a particular spiritual, emotional, romantic, financial, professional, legal, or personal result or timeline. Individual experiences vary and may be affected by personal circumstances, beliefs, choices, consistency, and actions. Testimonials and customer experiences represent individual opinions and results and are not guarantees.

Our products and content are intended to complement personal reflection and intentional action—not replace judgment, personal responsibility, practical action, or qualified professional assistance.

10. HEALTH AND PROFESSIONAL-ADVICE DISCLAIMER

Our products, product names, descriptions, traditional correspondences, blog posts, social-media content, readings, rituals, and educational materials are not medical, psychological, psychiatric, pharmaceutical, legal, financial, or other licensed professional advice.

Nothing we provide is intended to diagnose, treat, cure, mitigate, or prevent disease, illness, injury, or a mental-health condition. Do not delay, disregard, or discontinue professional care because of our products or content. Consult an appropriately qualified professional regarding your health, medications, pregnancy, nursing, allergies, finances, legal matters, or other circumstances requiring professional guidance. Contact emergency services or an appropriate crisis resource in an emergency.

Statements regarding traditional, spiritual, metaphysical, or wellness uses have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

11. PRODUCT USE, ALLERGIES, AND SAFETY

Always review and follow the applicable listing, ingredient information, packaging, instructions, and warnings. Use each product only for its stated purpose. “Natural,” “botanical,” “handcrafted,” or “spiritually prepared” does not mean risk-free or appropriate for every person.

Topical and aromatic products

Intention oils, spiritual colognes, ritual sprays, lotions, soaps, bath products, and other topical or aromatic offerings must be used only as directed. Review ingredients before use, particularly if you have allergies or sensitive skin. When appropriate, perform a small patch test before broader application. Avoid the eyes, mouth, mucous membranes, and irritated or broken skin. Discontinue use if irritation or another unexpected reaction occurs and seek professional medical advice when appropriate.

Ingestion and herbal products

Only products expressly labeled and sold by Lucid and Wild Collective as herbal tea or otherwise intended for consumption may be ingested. Do not ingest intention oils, spiritual colognes, ritual sprays, bath products, incense, resins, curios, ritual botanicals, crafting herbs, spell-kit components, or any item not expressly labeled for consumption.

Herbs and teas may cause allergic reactions or interact with medications, supplements, pregnancy, nursing, or health conditions. Review all ingredients and consult a qualified healthcare professional when appropriate.

Candles, incense, smoke, and heat

Never leave a burning candle, incense stick, charcoal, resin, or other combustible material unattended. Use a stable, heat-resistant holder and keep flames, embers, smoke, hot wax, loose botanicals, papers, fabrics, children, and pets at a safe distance. Follow all listing and label instructions. Extinguish immediately if flame behavior becomes unsafe.

Use smoke-producing and aromatic products in a well-ventilated area. Consider the sensitivities of children, pets, pregnant individuals, and people with respiratory or fragrance sensitivities.

Crystals, stones, curios, and small components

Crystals, stones, charms, curios, and altar tools are decorative, spiritual, or ritual items—not medical devices. Do not ingest them or place them in drinking water unless their safety has been independently confirmed by a qualified expert. Some minerals may be toxic, water-reactive, sharp, fragile, or unsafe for food contact. Keep small, sharp, and breakable components away from children and pets.

You are responsible for safe storage, handling, and use and for complying with the directions and warnings accompanying the product.

12. PERSONAL USE AND RESALE RESTRICTIONS

Unless a product is expressly identified and sold by Lucid and Wild Collective as a wholesale item, all products, services, digital materials, ritual instructions, and educational content are sold or licensed for personal use only.

Purchases may not be resold, redistributed, reproduced, duplicated, repackaged, relabeled, altered for resale, incorporated into another product for sale, or otherwise used commercially without our prior written authorization. Purchasing multiple quantities does not create wholesale status or grant resale rights. Personal gifting is permitted when it is not part of a commercial transaction or promotional distribution.

13. WHOLESALE EXCEPTION

The personal-use restriction does not apply to products expressly designated as wholesale in the applicable listing, invoice, or written wholesale agreement. Only the specific products and quantities purchased through an approved wholesale offering may be resold.

Wholesale authorization does not permit a purchaser to remove or obscure required information; alter our branding; represent our products as the purchaser’s own creations; repackage or reformulate without written permission; reproduce our descriptions, photographs, labels, instructions, formulas, or proprietary materials; make unauthorized medical, therapeutic, or spiritual-result claims; or market products in a misleading, unlawful, or unsafe manner.

Wholesale eligibility applies only to the approved transaction and does not automatically extend to future purchases.

14. DIGITAL LICENSE AND INTELLECTUAL PROPERTY

Digital downloads, guides, courses, ritual materials, readings, and other digital content are licensed to the original purchaser for personal use only. They may not be copied, shared, uploaded, taught, distributed, resold, commercially reproduced, or made available to another person or group unless we grant written permission or a separate commercial license.

All original website text, product descriptions, photographs, graphics, branding, labels, downloads, ritual instructions, educational materials, and other original content owned by Lucid and Wild Collective are protected by applicable intellectual-property laws. No purchase transfers ownership of our intellectual property.

You may not reproduce, distribute, modify, publish, sell, exploit, scrape, or create commercial derivative works from our protected content without prior written permission.

15. REVIEWS, COMMENTS, AND CUSTOMER SUBMISSIONS

You are responsible for content you submit through reviews, comments, messages, photographs, or other public-facing features. Your submission must be truthful, lawful, and must not violate another person’s intellectual-property, privacy, publicity, or other rights.

When you voluntarily submit content for public posting, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display that content in connection with our website, products, and marketing, subject to applicable law. This does not give us permission to publicly disclose private order information or confidential communications without authorization.

We may moderate or remove unlawful, abusive, deceptive, infringing, threatening, discriminatory, obscene, malicious, or otherwise inappropriate content. We are not responsible for content posted by other users.

16. PRIVACY AND ELECTRONIC COMMUNICATIONS

Our collection and use of personal information are governed by our Privacy Policy. By using the Service or communicating with us electronically, you consent to receive transactional communications necessary to process orders, deliver products or services, provide support, maintain accounts, or administer the Service.

Marketing communications are governed by the choices and unsubscribe options provided with those communications and applicable law.

17. THIRD-PARTY SERVICES AND LINKS

The Service may contain third-party tools, payment services, applications, links, or materials. We do not control third-party services and provide access to them on an “as available” basis. Your use of a third-party service may be governed by that party’s terms and privacy practices. To the fullest extent permitted by law, we are not responsible for third-party content, availability, security, acts, omissions, products, or services.

18. PROHIBITED USES

You may not use the Service to violate law; infringe intellectual-property or privacy rights; transmit malicious code; scrape or harvest information without authorization; commit fraud; submit false information; interfere with security or operation; harass, threaten, defame, abuse, or discriminate against another person; impersonate another person; engage in unauthorized resale; or use our products or content for an unsafe or unlawful purpose.

We may restrict or terminate access for a violation of these Terms.

19. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Service and all products, content, and services are provided “as is” and “as available,” except for warranties expressly provided by us or rights that cannot legally be excluded. We do not warrant that the website will always be uninterrupted, secure, current, or error-free, or that a product or service will satisfy subjective expectations or produce a particular metaphysical result.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the maximum extent permitted by law.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Lucid and Wild Collective and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, loss of data, or replacement costs, arising from or relating to the Service, products, content, or these Terms.

To the fullest extent permitted by law, our aggregate liability for a claim relating to a product, service, or order will not exceed the amount you paid to us for the product, service, or order giving rise to that claim.

These limitations do not exclude liability or consumer rights that cannot lawfully be excluded or limited. Nothing in these Terms releases any party from liability to an extent prohibited by applicable law.

21. ASSUMPTION OF RESPONSIBILITY

You agree to read and follow product-specific instructions and warnings and to exercise reasonable judgment. You accept the risks reasonably associated with flames, heat, smoke, fragrance, botanicals, allergens, glass, breakable items, sharp materials, small components, and the misuse or unintended use of products.

We are not responsible for harm caused by failure to follow instructions, use for an unintended purpose, improper storage, unauthorized alteration or combination, undisclosed sensitivities, or reliance on spiritual content instead of appropriate professional advice, except to the extent liability cannot legally be excluded.

22. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Lucid and Wild Collective and its owners, officers, employees, contractors, service providers, and affiliates from third-party claims, liabilities, damages, and reasonable costs arising from your violation of these Terms, unlawful misuse of the Service or a product, infringement of another party’s rights, unauthorized resale or relabeling, or content you submit.

23. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including carrier disruptions, severe weather, natural disasters, fire, utility or internet outages, labor interruptions, government actions, public emergencies, supplier interruptions, or other force-majeure events. This section does not eliminate any refund or remedy required by applicable law.

24. TERMINATION

We may suspend or terminate access to the Service if we reasonably believe you violated these Terms, engaged in fraud or abuse, created a safety or legal risk, or infringed another party’s rights. Provisions that by their nature should survive termination—including payment obligations, intellectual-property restrictions, disclaimers, liability provisions, and dispute terms—will survive.

25. GOVERNING LAW AND VENUE

These Terms and any separate agreement through which we provide the Service are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

Subject to applicable consumer-protection law, any legal proceeding relating to these Terms or the Service shall be brought in a state or federal court serving [INSERT BUSINESS COUNTY], Indiana, and the parties consent to that jurisdiction and venue.

26. SEVERABILITY, WAIVER, AND ASSIGNMENT

If a provision of these Terms is determined to be unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted, and the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, sale, reorganization, or transfer of the business, subject to applicable law.

27. ENTIRE AGREEMENT AND ORDER OF PRECEDENCE

These Terms and the policies, listings, warnings, and agreements incorporated into them constitute the entire agreement concerning the Service and supersede prior discussions or communications concerning the same subject.

If documents conflict, the following order applies: (1) a signed or expressly accepted written wholesale or service agreement; (2) product-specific safety instructions and warnings; (3) the policy specifically governing the issue; and (4) these general Terms. Mandatory applicable law controls over all documents.

28. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version and changing the “Last updated” date. Changes apply prospectively from the effective date unless applicable law permits otherwise. Your continued use of the Service after an update constitutes acceptance of the revised Terms. The version in effect when an order is placed generally governs that transaction unless a later change is required by law or agreed to by the parties.
